Terms of service

This Membership Agreement (“Agreement”) is entered into between Su’Luxe Wellness Studio, LLC (“Studio”) and the undersigned Member (“Member”). By signing below, Member agrees to the following terms.

1. MEMBERSHIP TERM & SERVICES

1.1 Membership Term

Member selects a 3-month, 6-month, or 12-month membership (“Term”), beginning on the purchase date (“Commencement Date”). The Term end date does not change due to pauses, frequency changes, or missed sessions.

1.2 Membership Options

Luxe Coaching (personal training):

12-Month Commitments:

  • 1x/week (4 sessions per month) - $165/month

  • 2x/week (8 sessions per month) - $280/month

  • 3x/week (12 sessions per month) - $390/month

  • 4x/week (16 sessions per month) - $520/month

6-Month Commitments:

  • 1x/week (4 sessions per month) - $180/month

  • 2x/week (8 sessions per month) - $300/month

  • 3x/week (12 sessions per month) - $420/month

  • 4x/week (16 sessions per month) - $560/month

  • Virtual Training - $125/Month

 Luxe Classes: 

3-month commitment:

  • 4 classes per month - $80/month

  • 8 classes per month - $150/month

  • 12 classes per month - $180/month

  • Unlimited classes per month - $220/month

Drop-in Fee:

  • $25/Class

1.3 Equipment & Facilities

At the time of signing, Studio provides access to:

  • Dumbbells (assorted weights)

  • adjustable benches

  • barbells

  • squat rack(s)

  • weight plates

  • Resistance bands, 

  • glute bands, 

  • step platforms, 

  • sliders, 

  • mats, 

  • foam rollers, 

  • stability balls, 

  • BOSU balls

  • Strength training room, group class room, bathrooms, reception area

  • Temperature-controlled environment (A/C & heat)
    Equipment may be added or upgraded over time.

1.4 Trainer Availability

If a Member’s assigned trainer leaves Su’Luxe, Studio will provide another qualified trainer. Trainer changes do not void or alter this Agreement.

2. STUDIO POLICIES & MEMBER RESPONSIBILITIES

2.1 Code of Conduct

Member must conduct themselves respectfully, follow trainer guidance, use equipment safely, and maintain hygiene and appropriate attire. Studio may terminate membership for unsafe or disruptive behavior without refund.

2.2 Attendance, Late Arrivals, Cancellations & No-Shows

  • 10-minute grace period: After 10 minutes, doors lock; entry not permitted.

  • Arrivals past 10 minutes = no-show + loss of credit.

  • 8-hour cancellation policy: Cancellations within 8 hours result in loss of credit.

  • No-show fee: $7 per no-show (in addition to losing credit).

  • No refunds or rollovers for unused or expired sessions. Credits reset each billing cycle.

2.3 Health & Safety

Member must not attend when ill or injured. Studio may refuse participation if Member appears unsafe to train. Studio may close or cancel classes for weather, emergencies, or safety reasons.

2.4 Membership Pauses

Member may pause once every two months, for up to one month, for a $30 pause fee. Pauses must be requested before the next billing date. The Term end date will be pushed back by the duration the membership was paused. .

2.5 Media & Photography

Member grants permission for Su’Luxe to use photos/video taken in classes or sessions for marketing, unless Member submits a written opt-out request.

2.6 Personal Belongings

Studio is not responsible for lost, stolen, or damaged items.

2.7 Damage to Studio Property

Member is responsible for repair or replacement costs for any intentional or negligent damage they cause.

2.8 Right to Refuse Service

Studio may refuse service or terminate membership for policy violations, safety risks, or misconduct.

2.9 Communication Consent

Member consents to receive texts, emails, and notifications for scheduling, billing, and studio updates.

2.10 Payment Disputes & Chargebacks

Member must contact Studio before disputing any charge. Improper chargebacks may result in collections or legal action.

2.11 Class Reservations & Waitlist

Member must reserve classes; waitlist promotions may occur automatically. Member is responsible for booking status. Late cancels and no-shows result in loss of credit and fees.

3. PAYMENT TERMS

3.1 Billing Cycle

Payments occur monthly on the same calendar date as purchase.

3.2 Automatic Billing

Member authorizes automatic charges to the provided payment method.

3.3 Failed Payments & Late Fee

If payment fails, the system retries for 7 days.

If still unpaid after 7 days, Member is in Default and a $15 late fee is added.

3.4 Frequency Changes & Proration

Member may request a change in membership frequency at any time.

By default, changes apply to the next billing cycle.

If Member requests immediate change, Studio may prorate the difference for the remaining days of the cycle.

3.5 No Refunds for Unused Services

There are no refunds or credits for unused sessions, missed sessions, or expired credits.

4. DEFAULT, COLLECTIONS & TERMINATION

4.1 Default

Member is in Default if:

  • Payment remains unpaid after 7 days

  • Member removes/blocks payment method

  • Member files an improper chargeback

  • Member refuses to update payment information

4.2 Studio Remedies

If in Default, Studio may:

  • Suspend access to services

  • Charge late fees

  • Accelerate the remaining Term balance

  • Send the account to collections after 21 days

  • Pursue small claims court

  • Terminate membership

5. BUYER’S RIGHT TO CANCEL

If you wish to cancel this contract, you may cancel by sending a written notice stating that you do not wish to be bound by this contract. The notice must be delivered or mailed before midnight of the third business day after you sign this contract. The notice must be delivered or mailed to:

5.1 Three-Day Right to Cancel

Member may cancel within 3 business days after receiving this signed Agreement for a full refund (minus value of used services).

You may also cancel this contract if:

5.2 Relocation (25+ Miles)

Member may cancel if moving more than 25 miles away (proof required).

5.3 Disability

Disability preventing participation allows cancellation or pause (with physician documentation).

If you become disabled, you shall have the option of:

(1) Being relieved of liability for payment on that portion of the contract term for which you are disabled; or

(2) Extending the duration of the original contract at no cost to you for a period equal to the duration of the disability.

You must send a written notice of disability, which may be sent to the health club in an electronic form. You may be required to prove such disability by submitting documentation from a licensed physician, a licensed physician assistant, a licensed advanced practice registered nurse or another credentialed medical provider. If you cancel, the health club may keep or collect an amount equal to the fair market value of the services or use of facilities you have already received.

5.4 Death

Member’s estate may cancel in the event of death.

5.5 Studio Closure

If the Studio permanently closes or relocates outside of 15 miles of original sign up location, Member may cancel.

6. RENEWAL AFTER TERM

6.1 Automatic End of Term

At the end of a 3-, 6-, or 12-month Term, this Agreement ends automatically.

6.2 Optional Month-to-Month Renewal

To continue after the Term, Member must provide written consent (text/email/written form) stating:

“YES, I want to continue month-to-month.”

Without written consent, billing stops and membership ends.

7. WAIVER, PRIVACY & GOVERNING LAW

7.1 Liability Waiver

Member acknowledges inherent risks of exercise and agrees to sign Studio’s separate liability waiver.

7.2 Privacy

Member information is securely stored and not sold or shared outside essential operations.

7.3 Governing Law

This Agreement is governed by the laws of the State of Connecticut.
